In India, trademarks are regulated by the Department of Industry and Commerce, Government of India, under the authority of the Controller General of Patents, Designs, and Trademarks. The registration process is governed by The Trademark Act, 1999. Once registered, the trademark becomes exclusive to the licensee, preventing others from using an identical trademark without permission. The registered trademark is denoted by the symbol "®", which can be used for ten years from the date of registration.

Steps Involved in Trademark Registration Process
1. Filing Trademark Application: To initiate trademark filing, we first draft an authorization letter based on the documents you provide. This grants us the authority to proceed with trademark registration on your behalf. Subsequently, we submit the application to the Registrar of Trademarks. Upon submission, a TM receipt is issued, granting you the right to use the ™ symbol.
2. Examination Report: Following the application filing, the examiner reviews the submission and issues an examination report. If the Trademark Examiner identifies similarities with existing trademarks, they may issue a notice of objection. A response to the objection must be provided within 30 days.
3. Response to Objection: Should your trademark application face objection from the Trademark Examiner, a reply is submitted for examination by the Trademark officer. The decision to accept or reject the application rests with the Trademark officer.
4. Trademark Hearing: Upon submission of the reply, a Show Cause Hearing may be scheduled for presenting evidence of use and arguments for registration before the Registrar of Trademarks.
5. Advertisement in Journal: Upon acceptance by the registry, the trademark application is published in the trademark journal for a period of four months.
6. Opposition Period: During the four-month period of trademark publication, the public has the right to oppose the brand. If no opposition is raised within this timeframe, the trademark proceeds to registration.
7. Issuance of Trademark Certificate: Upon registration, the trademark certificate is provided online by the registry. Following registration, the applicant gains the right to use the ® symbol with their brand or logo.
8. Trademark Renewal: The trademark remains valid for 10 years and can be renewed by the applicant before expiration.
